The Tutoring Contract

This contract will serve as the basis for all tutoring

arrangements between The Client, The Tutor and Client (Parent, for the students under the age of 18 years) for the entirety of lessons until the termination date as agreed by all parties.

Obligations of the Tutor

The Tutor is contracted independently to provide his/her services to the Company. This agreement shall not be construed as a contract of employment, and the Tutor shall not be an employee of the company.
The Tutor has agreed to provide tutoring services to clients introduced to them by the Agency.
The Tutor will be free to do any other work of his/her choice, provided there is no conflict of interest.

Obligations of the Company.

The Company warrants that Tutor possesses a valid teaching certificate of practitioner license which is appropriate to the age and grade level of the student(s)
The Company agrees to meet with the Family, including both student(s) and parent(s), at least twice per month of instruction
The Company agrees that at least one of these two contacts will be made face-to-face with the student(s), and that the other may be made by telephone or e-mail, at the Company request.
The Company offers to consult with and advise the parent(s), as requested by the student parent(s) or as deemed necessary in the professional judgment of the Tutor.
The Tutor agrees to provide formal and/or informal assessments of the student(s progress to the Family, in the manner reasonably requested by the Client.
The Client agrees to maintain a diary, record, or log of visitations.

Obligations of the Tutor

The Tutor agrees to carry out all necessary research prior to each lesson so as to maximize the Student’s learning time.
The Tutor agrees to keep all information regarding the Student education confidential unless written permission has been granted by the Student to disclose. This includes any work that the Student has produced during or out with lesson times.
The Tutor agrees to carry out all lessons in person unless a prior arrangement has been made to conduct lessons online.
The Tutor shall not sub-contract to another tutor for lessons that are intended to be conducted by him or herself.
The Tutor shall not complete homework or any other classroom assignments that are intended for completion by the Student.
The Tutor undertakes to do all preparation prior to lessons and to structure lessons in such a way as to optimize time to the benefit of the Student.
The Tutor shall keep confidential all information of the Student and shall contact other parties involved in the education of the Student only if given written permission by the Student to do so.
The Tutor shall not assign any of his/her duties or obligations under this tutoring contract to a third party without the written permission of the Client.
The Tutor shall at no time be required or obliged to execute homework or assignments on behalf of the Student.

Obligations of the client

The Student agrees to attend all scheduled lessons and be pro-active in making suggestions about their own education.
The Student agrees to complete any homework or classwork assignments set by the Tutor in a timely manner as agreed prior to the task being set.
The Student understands that it is not within the Tutor remit to complete homework or classroom exercises on behalf of the student and that the Tutor role is one of support.

Tutors and Clients

Parents - The Parent is not permitted to make private arrangements for tuition with a Tutor introduced by The Company. Should a Parent breach this obligation, they will be liable to The Company for all sums paid to the Tutor without deduction and The Company shall be entitled to obtain an injunction against a Client to prevent further breaches. This obligation shall continue notwithstanding termination of this agreement.
Tutors - In consideration of The Company providing you with students, you are not permitted to make private arrangements for tuition with clients introduced by The Company
Should you breach this obligation, you will be liable to The Company for all sums received by you from the client/new client without deduction and The Company shall be entitled to obtain an injunction against you to prevent further breaches. This obligation shall continue notwithstanding termination of this Agreement.
The Company acts as agent on behalf of the tutor and the student.

The Company is only responsible for finding students and an appropriate teacher for the specific subject, and is not responsible for the content of lessons and the teaching methods.

Termination of Tutoring Contract

This tutoring contract can be terminated by the Company, The Student or The Client at any time within 30 days prior to notice.

The agreed date of payment is not later than 2nd day after delivery of invoice.
